1. Acceptance of Terms
By accessing or using the Arcade Health mobile application and related services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Services.
These Terms constitute a legally binding agreement between you and Arcade Health, Inc. ("Arcade Health," "we," "us," or "our").
2. Description of Services
Arcade Health provides a mobile application that enables you to:
- Access and view your health records from connected healthcare providers
- Manage health records for your minor dependents (as an authorized guardian)
- Receive personalized health insights from our AI assistant (Arcade AI)
- Track wellness metrics from wearable devices and health apps
- Coordinate care with family members and healthcare providers
3. Eligibility
To use the Services, you must:
- Be at least 18 years of age
- Have the legal capacity to enter into these Terms
- Provide accurate and complete registration information
- For dependent access: Be the legal guardian or have authorized proxy access
4. Account Registration and Security
When you create an account, you agree to:
- Provide accurate, current, and complete information
- Maintain the security of your password and account
- Notify us immediately of any unauthorized access
- Accept responsibility for all activities under your account
We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.
5. Guardian and Proxy Access
If you access health records for a minor dependent or other individual through proxy access, you represent and warrant that:
- You are the legal guardian or have been granted authorized proxy access by the healthcare provider
- You will use the access only for legitimate healthcare management purposes
- You will comply with all applicable laws regarding minor privacy and healthcare information
- You understand that proxy access may be limited or revoked based on the dependent's age or state law
6. Healthcare Provider Connections
When you connect to healthcare providers through our Services:
- You authorize us to retrieve health records on your behalf using secure APIs
- You acknowledge that we access data through the provider's patient portal systems
- You may disconnect at any time, which revokes our access to retrieve new data
- Previously retrieved data may be retained according to our Privacy Policy
7. Not Medical Advice

THE SERVICES ARE FOR INFORMATIONAL PURPOSES ONLY AND DO NOT CONSTITUTE MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT. Always consult with qualified healthcare professionals for medical decisions.
- Our AI assistant provides general health information, not medical advice
- Health insights and recommendations are not substitutes for professional medical care
- In case of emergency, call 911 or go to the nearest emergency room
- We do not provide clinical services or prescribe treatments
8. Acceptable Use
You agree not to:
- Access health records for individuals without proper authorization
- Share your account credentials with others
- Use the Services for any unlawful purpose
- Attempt to gain unauthorized access to our systems
- Interfere with or disrupt the Services
- Reverse engineer, decompile, or disassemble any part of the Services
- Use automated means to access the Services without permission
- Misrepresent your identity or relationship to dependents
9. Intellectual Property
The Services, including all content, features, and functionality, are owned by Arcade Health and are protected by copyright, trademark, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to use the Services for personal, non-commercial healthcare management purposes.
10. Privacy
Your use of the Services is also governed by our Privacy Policy, which describes how we collect, use, and protect your information, including Protected Health Information (PHI).
11. Third-Party Services
The Services integrate with third-party healthcare systems and services. Your use of these integrations is subject to the third party's terms and privacy policies. We are not responsible for third-party services, content, or practices.
12. Disclaimer of Warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
- The Services will be uninterrupted, secure, or error-free
- Health records will be complete or accurate (data comes from healthcare providers)
- The Services will meet your specific requirements
- Any errors will be corrected
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARCADE HEALTH, INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES.
Our total liability for any claims arising from these Terms or your use of the Services shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or $100, whichever is greater.
14. Indemnification
You agree to indemnify, defend, and hold harmless Arcade Health and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from:
- Your use of the Services
- Your violation of these Terms
- Your violation of any third-party rights
- Unauthorized access to dependent health records
15. Termination
You may terminate your account at any time through the app settings or by contacting us. We may suspend or terminate your access if you violate these Terms or for any other reason at our discretion.
Upon termination, your right to use the Services ceases immediately. Provisions that by their nature should survive termination will remain in effect.
16. Changes to Terms
We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms in the app and updating the "Last Updated" date. Your continued use after changes constitutes acceptance of the modified Terms.
17. Governing Law and Disputes
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association rules, except that either party may seek injunctive relief in court.
18. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
19. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Arcade Health regarding the Services and supersede all prior agreements.
